The Client and the Employer's Agent
Most commonly, an Employer's Agent is used with a Design and Build contract. A Design & Build (sometimes called Design & Construct) contract is when a client wishes to one organisation to be responsible for undertaking both the design and the construction of their development.
This contract envisages the employer's agent undertaking the employer's duties on behalf of the employer, ensuring that the client's requirements are met in full and that they receive the best possible value for money. Chartered Quantity Surveyors frequently undertake this role.

Acting on behalf of the Client/Employer in respect of administration of a 'Design and Build' contract, incorporates the preparation of tender documentation and the issue of all notices and certificates.
